ABOUT THE PROGRAMME

March 2020 marks the 10th anniversary of the Mental Capacity Act coming into force. The MCA was a revolutionary piece of legislation, transforming the law relating to mental capacity (or more accurately, mental incapacity), thereby eliminating many problem areas for lawyers (and the lay population). However, over time, different problems have emerged as a result of the MCA. 

This seminar will focus on 2 thorny areas:

1. Problems arising from applications for deputyship orders under the MCA; and
2. Whether lawyers have a duty to assess and determine their clients’ mental capacity, and if so, what is expected of lawyers. This is important in the light of recent Singapore cases  such as Re BKR (and the satellite disciplinary proceedings in connection with the case) and BUV v BUU.
