Civil Claims

Civil litigation is generally the commencement of a suit in the Singapore Court system or in another prescribed dispute resolution system. Parties may sue, or be sued, because of breach of contract, negligence, or some other breach of duty as recognised by law. The remedies that may be ordered are usually monetary compensation or some other order as the Court may deem fit at the end of the dispute.

Parties may also appeal against decisions made to a higher Court although there are strict rules to limit the appeal avenues available to parties.

A lawsuit may take between 9 months to more than 2 years, depending on the complexity of the matter. An appeal, whether at the end of the suit, or even during the suit, could lengthen the process.

Viviene has represented and defended clients in all areas of civil litigation. She has handled a broad spectrum of cases ranging from simple cases to complex and contentious matters at all levels of the Singapore Court hierarchy. From time to time, she handles minor criminal matters stemming from road traffic offences, assault cases to minor drug offences.

As well as being a litigator, Viviene is an accredited mediator. She received her mediation training from Regent’s University London and the Singapore Mediation Centre and has been an Associate Mediator with the State Courts and Singapore Mediation Centre since 2010. She is currently also a Senior Mediator with the Law Society Mediation Scheme and an accredited mediator with the Singapore International Mediation Institute. Viviene has conducted several mediations on a variety of disputes at the State Courts Court Dispute Resolution Centre, Small Claims Tribunal, the Singapore Mediation Centre and the Law Society of Singapore.

Viviene is an Assigned Solicitor with the Legal Aid Bureau and a Primary Justice Lawyer at the Community Justice Courts.

In 2017, Viviene received her arbitration qualifications and become a Fellow with the Singapore Institute of Arbitrators, thus enabling her to conduct Mediation-Arbitration.

In 2018, Viviene was awarded the State Court’s Outstanding Volunteer of the Year Award (Advocate & Solicitor Category Winner), in appreciation for her invaluable contributions to the judiciary.

Viviene’s aim is to help simplify legal processes and ensure that everyone receives good quality legal advice.

Viviene is happily married with three children. She enjoys being a lawyer and helping others where she can.

Michael was called to the Singapore Bar in 1992 after graduating from the National University of Singapore.

A large portion of his practice involves family and divorce matters. Michael approaches these cases as both a legal practitioner and a family-oriented individual. Michael understands that divorce proceedings involve emotional issues which may or may not be adequately addressed using only legal means — so he is able to advise clients based on a larger picture.

In the area of general litigation, he has handled defamation cases, will disputes, trusts, claims over joint assets and information technology issues. Most recently, he handled two pre-litigation evidence seizure cases (Anton Pillar Orders).

In criminal matters, he has helped clients obtain fair results, including the reduction of penalties and forfeiture of bail.

Currently, he acts as an advisor to several companies, assisting them in their legal and non-legal matters and issues, including restructuring exercises.

In the field of Entertainment Law and Intellectual Property Law, he counts well-known celebrities and talent management companies among his clients.

Married with two school-age boys, he is an alumnus of Anglo Chinese School and Junior College.
