Offences Against Property

Offences against Property are dealt with in Chapter XVII of the Penal Code.

A moveable property is anything that can be moved. Anything that is attached to the earth cannot be a subject of theft; however it can be a subject of theft once it is severed from the earth.

Consent, where mentioned in the sections, maybe expressed or implied and may be given by the person in possession of the property or by any person having proper authority over the property.

The various types of such crimes are:

• Theft (S378 & S 379)
  
• Theft of Motor Vehicle (S379A)
  
• Theft in a dwelling-house, etc (S380)
  
• Theft by "employee" (S381)
  
• Theft after preparation made for causing death or hurt in order to commit theft (S382)
  
• Extortion (S383 & S384)
  
• Extortion with Fear of Death or Grievous Hurt (S386)
  
• Robbery (S390 & S392)
  
• Voluntarily causing hurt in committing robbery (S394)
  
• Gang-robbery (S 391 & 395)
  
• Criminal misappropriation of property (S403)
  
• Dishonestly receiving stolen property (S411)
  
• Cheating (S415, S417 & S420)
  
• Mischief (S425 & S426)
  
• Committing mischief and causing damage more than $ 25 (S427)
  
• Criminal Trespass (S441 & S447)
  
• House-trespass (S442 & S448)
  
• House-breaking (S445 & S453)
