A. WHAT A LAWYER NEEDS TO PREPARE TO APPLY FOR A PRACTISING CERTIFICATE ('PC')

 

Jan to Feb

• Have your accountant prepare your accountant's report.

Jan to Feb

• If you qualify for an exemption or wish to apply for a waiver of the requirement to submit an accountant's report, write to the Council (attention to the Director, Compliance Department) together with a statutory declaration setting out the reasons for your request.

Jan to Feb

• If you were required to vote in the 2010 Council election (or the last time you practised) but did not do so and have a good and sufficient reason for not voting, write to the Registrar, Supreme Court to seek waiver of the requirement to pay the $500 penalty for not voting.

Jan to Feb

• Pay your Singapore Academy of Law membership subscription.

 

• If you intend to pay the Law Society's membership subscription and compensation fund contribution by GIRO but do not have a GIRO facility, submit a GIRO facility application to the Law Society. (The approval process is approximately 4 weeks)

From 1 March

• Submit to the Law Society the application form with original copies of accountant's reports (if required) and cheque payments (unless payment is by GIRO).

 

• Obtain mandatory professional indemnity insurance cover through the Law Society's Compulsory Professional Indemnity Scheme broker - Lockton Companies (Singapore) Pte Ltd.

 

B. WHAT TO BRING TO THE LAW SOCIETY WHEN SUBMITTING THE APPLICATION FOR APPROVAL TO FILE A PRACTISING CERTIFICATE

 

  • 4 copies of Part I and 2 copies of Part II & III of the duly completed Application for Approval to E-File PC form (available from www.lawsociety.org.sg > Running Your Practice > Forms).

  • 2 separate cheque payments for membership subscription and compensation fund contribution (made payable to 'The Law Society of Singapore') if you are not making payment by GIRO.

  • Original accountant’s report OR copy of the Law Society's letter granting waiver/exemption from submitting an accountant's report (if applicable).

  • Copy of the letter from the Registrar of the Supreme Court stating that you have a good and sufficient reason for not voting at the Council election (if applicable) OR a cheque of $500 payable to 'The Law Society of Singapore' as penalty for the failure to vote.

 

 

C. CHECKLIST FOR THE ACCOUNTANT'S REPORT

 

  • You need an accountant's report if, for the last calendar year or any part thereof, or when you last practised, you have been:

    • A sole proprietor;

    • A partner of a partnership (including a limited liability law partnership) whether equity or salaried partner;

    • A director of a law corporation (including a lawyer held out as a director, e.g. an associate director or senior associate director);

    • A lawyer who held or received client money of the law practice.

  • If you practised in more than one law practice during the course of the last calendar year (or when you last practised) and any of paragraphs 1(a) to (d) apply to you, you must submit a separate accountant’s report for each law practice that you practised in.

  • Check your accountant’s report for the following:

    • Your full name, name of law practice, office address and designation in the law practice are correctly stated.

    • The accounting period correctly states the period that you practised in the law practice and held client money.

    • The accountant signs the report stating his name, NRIC number and name of his accounting practice.

    • At paragraph 2 of the report, the 2 dates chosen were dates falling within the accounting period during which you had practised in the law practice.

    • If you ceased practice in a particular law practice, your report must be titled 'Final Accountant's Report' and indicate the date you ceased to practise and ceased to hold client money.
